These Terms of Service (the “Terms”) are an agreement between you and Adrian Duardo (“we”, “us”) governing your use of the MASA mobile game for Android (package name win.starfleet.masa, the “Game”).

They should be read together with our Privacy Policy, which explains how we handle your data and forms part of these Terms.

1. Acceptance and eligibility

By downloading, installing or playing the Game you accept these Terms. If you do not accept them, do not use the Game.

You must be at least 13 years old to play, or at least 16 if you live in a country of the European Economic Area where 16 is the age of digital consent. If you are below the age of majority where you live, you may only play with the permission of a parent or guardian, who accepts these Terms on your behalf. The Game is not directed to children and is not part of the Google Play “Designed for Families” programme.

2. The game

MASA is a free single-player physics platformer: thirty levels across three regions, one finger, no jump button. It is fully playable offline and requires no account. The only part that needs a network connection is the leaderboard.

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Game on devices you own or control, for your own private, non-commercial entertainment. Any use outside that licence requires our written permission.

3. Your leaderboard entry

  • There is no registration. The first time the Game contacts the leaderboard it creates an anonymous entry identified by a random number generated on your device. You do not choose it and you never see it.
  • That identifier is not a secret and is not treated as one. Anyone who copies it off your device can post times under your entry. It is a deliberate trade-off — the alternative was making you register before you could compete — and what is at stake is a position in a table.
  • Because the entry is anonymous, we cannot recover it for you. If you uninstall the Game or clear its storage, the identifier is gone and the Game will create a new entry. Your local progress is on your device and follows the same rule.
  • One entry per person. Creating additional entries to fill the top of a leaderboard, or to evade the removal of a record, is prohibited (see section 5).
  • You can have your leaderboard entry and everything attached to it deleted at any time — see the deletion section of the Privacy Policy.

4. Player names

Your name on the leaderboard is generated by us from your random identifier. The Game does not let you type one, so there is no user-submitted text anywhere in MASA — no names, no chat, no messages, no comments.

If we ever add a way to choose your own name, these Terms will require it not to be offensive, not to impersonate anybody, not to contain another person's personal data or advertising, and not to infringe anybody's rights — and we will be able to change or reset any name that breaks those rules. Until then, there is nothing here for you to get wrong.

5. Fair play and prohibited conduct

The Game verifies every record by re-simulating the run you upload, so a forged time is rejected rather than ranked. That is a technical safeguard, not permission to try. You agree not to:

  • submit runs that were not played by you on an unmodified copy of the Game — including runs produced by a bot, a solver, a script, a macro or an automated tool;
  • modify the Game, its physics engine or its level data, or use a modified client, in order to obtain a time you could not obtain by playing;
  • reverse engineer, decompile, disassemble or attempt to extract the source code or assets of the Game, except to the extent that applicable law expressly permits it;
  • access our servers or APIs by any means other than the official Game client, or build tools, trackers or services on top of them without our written permission;
  • interfere with the service — denial-of-service attempts, abusive request volumes, probing for vulnerabilities, or attempts to make the server do work on your behalf;
  • manipulate the leaderboards by using multiple entries, or by submitting other people's runs as your own;
  • use the Game to break the law.

If you find a security vulnerability, we would rather hear about it than read about it. Report it privately to aduardoyanes@gmail.com and give us reasonable time to fix it.

6. No purchases, no advertising

There is nothing to buy in MASA and nothing to sell you. No in-app purchases, no subscriptions, no virtual currency, no loot boxes, no season pass — and no advertising of any kind. The Game contains no advertising SDK, and it never touches your Advertising ID.

Nothing in the Game has monetary value. Medals, completed levels, best times and leaderboard positions are not property, are not transferable, and are not convertible into money, goods or anything of real-world value. Selling, trading or offering a leaderboard position is prohibited, and any position obtained that way will be removed.

7. Records, medals and engine versions

A record exists only when our server has re-simulated the run and derived the time itself. We may reject a run that fails verification, that does not match the level it claims, or that we reasonably believe was not produced by ordinary play.

Leaderboards are separated by engine version. If we change a physics constant, old times stop being comparable with new ones, so they leave the active board. Those runs are not deleted — they were real games — but they belong to a different game and mixing them into the same list would be the lie. The same applies when a level's layout changes.

We may add, change, rebalance or remove levels, medal thresholds and game rules in order to keep the Game playable and fair. Medal thresholds are targets, not promises: one may become harder or easier in a future version.

A run that reaches the top 100 of a level can be downloaded by other players as a ghost to race against. By uploading a run you grant us a worldwide, royalty-free licence to store it, verify it, rank it and serve it back to other players inside the Game for that purpose, for as long as your leaderboard entry exists.

8. Availability and changes to the Game

The Game itself works offline and does not depend on us being online. The leaderboard is provided as an ongoing service, and we do not guarantee that it will be available without interruption or free of errors. We may take it offline for maintenance, updates or reasons beyond our control; when that happens the Game keeps working and your runs upload later.

We may change, suspend or discontinue the leaderboard, and we may discontinue the Game entirely. If we shut it down permanently, we will give reasonable notice through the Game or this website where we can. Because the Game is free and nothing in it has monetary value, no compensation is due for such changes.

9. Removal of records and entries

You may stop playing at any time by uninstalling the Game, and you may have your leaderboard entry deleted as described in the Privacy Policy.

We may remove a record, remove a leaderboard entry, or block further submissions from it, with or without notice depending on the seriousness of the case, if it breaches these Terms — in particular section 5 — or if we are required to do so by law. Where the circumstances allow it, we will explain why and give you a chance to reply at aduardoyanes@gmail.com. Removal affects the leaderboard only: the Game and your local progress keep working.

10. Intellectual property

The Game and everything in it — code, physics engine, level design, artwork, sound, music and theMASA name — belong to us or to our licensors and are protected by copyright and other laws. These Terms do not transfer any of those rights to you.

You may share screenshots, recordings and streams of your own play, including on monetised channels, provided you do not claim the Game as your own work and do not suggest we sponsor or endorse you.

If you send us feedback, ideas or suggestions, you grant us a free, perpetual, irrevocable licence to use them without any obligation towards you. Please do not send us anything you consider confidential.

Android and Google Play are trademarks of Google LLC. We are not affiliated with, endorsed by or sponsored by Google LLC.

11. Disclaimer of warranties

To the fullest extent permitted by law, the Game is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Game will meet your expectations, that it will be uninterrupted or error-free, or that leaderboard positions and records will always be preserved.

Nothing in these Terms excludes or limits any right you have as a consumer under the mandatory law of your country of residence.

12. Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special or consequential damages, nor for loss of data, loss of progress, loss of records or leaderboard positions, or loss of profit or opportunity, arising out of or in connection with the Game.

Because the Game is supplied free of charge and involves no payment from you, our total aggregate liability to you for any claim relating to the Game is limited to the greater of the amount you have paid us (which is zero) or EUR 50.

Nothing here limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law.

13. Governing law and disputes

These Terms are governed by the law of the country in which the developer is established. Nothing in this section deprives you of the protection of the mandatory consumer law of your own country of residence, or of the right to bring proceedings before the courts that applicable consumer law makes available to you.

If you live in the European Union, mandatory consumer protection law of your country of residence still applies to you, and you may bring proceedings before the courts of that country. Before going to court, please write to us — most problems are quicker to solve by email.

If any provision of these Terms is found invalid or unenforceable, the rest remains in force and the invalid provision is replaced by the valid one that comes closest to its intent.

14. Changes to these Terms

We may update these Terms when the Game changes or when the law requires it. The Last updated date at the top of this page always reflects the current version, and we will give notice inside the Game before a material change takes effect. If you do not agree with the updated Terms, stop using the Game and request deletion of your leaderboard entry. Continuing to play after a change means you accept it.
